Benjamin Allyn evaluates potential homeowner, business, and commercial property matters. Every claim is reviewed individually based on the policy, facts, evidence, deadlines, disputed issues, potential recovery, and work required.
Client-funded costs
Claim and litigation costs are separate from attorney fees. The client is responsible for costs and is required to fund them as provided in the engagement agreement.
The Allyn PC fee credit
10% before suit. 33⅓% after suit. No duplicate percentage on the same recovery.
For qualifying matters, the pre-litigation fee is generally 10% of Gross Recovery for investigating, documenting, presenting, negotiating, and adjusting the claim before suit.
If a lawsuit is filed, the litigation fee is generally 33⅓% of Gross Recovery. Any Allyn PC fee previously earned or paid on the same recovery is credited dollar-for-dollar against that litigation fee.
The client does not pay both Allyn PC percentages cumulatively on the same recovery.
Example: $100,000 Gross Recovery
Total Allyn PC fee: $33,333, subject to the signed agreement—not $43,333.
Why starting with one firm may matter
A policyholder who hires one professional to adjust a claim and later hires separate litigation counsel may have obligations under two different contracts. The combined cost depends on those contracts and the recoveries to which they apply.
Allyn PC's integrated structure is different: the firm can develop the claim before suit and litigate it if necessary, while crediting its own pre-suit percentage against its litigation percentage on the same recovery. That can reduce duplicated fees, avoid transferring the file, and preserve one continuous strategy.
